Terms of Service

1. About De Loupe

De Loupe ("De Loupe," "we," "our," or "us") is a photography critique platform where photographers submit work and receive structured written feedback from a community of fellow photographers. By creating an account or using any part of the De Loupe platform, you agree to these Terms of Service.

De Loupe is not a social network, a portfolio platform, or a photo storage service. Photographs submitted to De Loupe are removed from the platform after their development arc is complete — when a photographer-chosen time limit expires or five critiques are received, whichever comes first.

2. Eligibility

You must be at least 18 years of age to create a De Loupe account. By creating an account you represent that you are 18 or older and that the information you provide is accurate and complete.

You may only maintain one De Loupe account. Duplicate accounts may be removed at our discretion.

3. Your Account

You are responsible for maintaining the security of your account credentials. De Loupe is not liable for any loss resulting from unauthorized use of your account. If you suspect unauthorized access, contact us immediately at hello@deloupeapp.com.

Your display name and profile information are visible to other members. Your email address is never displayed publicly.

4. Content You Submit

By submitting a photograph to De Loupe, you confirm that you are the original photographer and copyright holder of the image, or that you have the right to submit it. You retain all ownership of your photographs.

You grant De Loupe a limited, non-exclusive license to display your photograph on the platform for the duration of its development arc, and to include it in your development record PDF. This license ends when the photograph is removed from the platform.

Critiques you write are also your content. You retain ownership of your written feedback. By submitting a critique you grant De Loupe permission to compile it into the photographer's development record PDF and deliver it to them.

5. Prohibited Content

The following content is strictly prohibited on De Loupe and will result in immediate removal and potential account suspension:

Photographs containing nudity, sexually explicit material, graphic violence, or content that sexualizes minors. Photographs that are not the original work of the submitting member. Content that is defamatory, harassing, threatening, or abusive toward any individual. Spam, commercial solicitation, or content unrelated to photography critique.

De Loupe uses automated content moderation to screen all uploaded photographs before they appear on the platform. Images that fail automated screening are held for human review. You will be notified if your photograph is rejected and the reason why.

6. The Critique Exchange

De Loupe operates on a critique exchange model. To unlock feedback on your submitted photographs, you must give critiques to other photographers. The current model is one critique given unlocks access to received feedback. This ratio may change as the platform evolves.

Critiques must be substantive, specific, and respectful. Responses of fewer than 20 characters, generic praise, or abusive feedback may be removed and may affect your critique quality score. Repeated low-quality critiques may result in account restrictions.

7. Development Records and Data Retention

When a photograph reaches the end of its development arc, De Loupe generates a PDF document — your development record — containing the photograph, your creator's note, and all approved critiques received. This PDF is emailed to you at the address associated with your account.

After the development record is delivered, the photograph file is deleted from De Loupe's servers within 5 days. The record of the submission — title, genre, date, critique count — remains in your profile archive indefinitely as a reference.

You are responsible for saving your development record PDF. De Loupe does not guarantee the permanent availability of historical PDFs.

8. Privacy

Your email address is used only to deliver notifications and your development record PDFs. We do not sell your personal information to third parties. Camera settings and EXIF data you choose to share with your submissions are visible to critics viewing your photograph on the Explore page.

De Loupe may use anonymized, aggregated usage data to improve the platform. This data cannot be used to identify individual users.

9. The Brand Directory

The De Loupe Market is a curated directory of photography-adjacent brands, services, and gear that have been reviewed and approved by De Loupe. Inclusion in the Market is a paid placement. De Loupe reviews all Market submissions and reserves the right to decline any brand that does not align with the values and aesthetic of the community.

De Loupe does not endorse or guarantee the quality of any product or service listed in the Market. Transactions between members and Market brands are solely between those parties.

10. Termination

You may delete your account at any time through the Settings page. Account deletion permanently removes your profile, photographs, and critiques given from the platform. Development records already delivered to you via email are not affected.

De Loupe may suspend or terminate accounts that violate these Terms of Service, engage in abusive behavior toward other members, or otherwise act in ways that harm the community. Repeated violations will result in permanent bans.

11. Limitation of Liability

De Loupe is provided "as is" without warranties of any kind. We are not liable for any loss of photographs, critiques, or data resulting from technical failures. We strongly recommend saving copies of any photographs you submit and all development record PDFs you receive.

De Loupe's total liability to you for any claim arising from use of the platform is limited to the amount you paid to De Loupe in the 12 months preceding the claim.

12. Changes to These Terms

We may update these Terms of Service as the platform evolves. We will notify members of significant changes via email. Continued use of De Loupe after changes are posted constitutes acceptance of the updated terms.
